Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the Flourish platform operated by Flourish (Pty) Ltd ("Flourish", "we", "us", or "our"), including the website flourishweightloss.com and the Flourish mobile application ("the Service").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

What the Subscription Includes

A Flourish subscription provides access to:

• The Flourish mobile application and web dashboard.
• A personalised GLP-1 nutrition and lifestyle plan generated for your cohort and progress stage.
• FIA, the AI health coach, available in-app at all times.
• Weight, measurement, and injection tracking tools.
• Progress analytics and weekly summaries.
• Access to book doctor consultations (consultation fees billed separately).

Medical Disclaimer

THE FLOURISH APPLICATION IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The app, including the FIA AI coach, provides general health information, coaching support, and tracking tools only. It is not a substitute for professional medical diagnosis, treatment, or advice.

Always consult a qualified healthcare provider before starting, changing, or stopping any medication or treatment. If you experience a medical emergency, contact your local emergency services immediately.

Any content generated by the FIA AI coach is for informational and coaching purposes only. It may not account for your individual medical history or current health status beyond the information you have provided in the app.

Doctor Consultations

Doctor consultations available through the Flourish platform are provided by Flourish Medical (Pty) Ltd or its designated registered practitioners ("the Medical Entity"), which is a separate legal entity from Flourish (Pty) Ltd.

By booking a consultation you enter into a separate agreement with the Medical Entity. Flourish (Pty) Ltd facilitates scheduling and payment but is not a party to the clinical relationship. The Medical Entity is responsible for all clinical decisions.

Billing, Renewal, and Cancellation

Your subscription is billed monthly (or at the interval stated at checkout) via the payment gateway selected at purchase. Subscriptions renew automatically at the end of each billing period unless cancelled.

To cancel your subscription: navigate to Settings → Subscription → Cancel in the app, or email support@flourishweightloss.com before the next renewal date. Cancellation takes effect at the end of the current billing period; you retain access until that date.

Refund policy: we offer a full refund if you request cancellation within 7 days of your first subscription payment and have not yet booked or attended a doctor consultation. After that period, or after a consultation has taken place, subscriptions are non-refundable for the current billing period. Consultation fees are non-refundable once the consultation has taken place. This does not affect any rights you may have under the Consumer Protection Act 68 of 2008.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of South African law.
• Impersonate any person or entity, or misrepresent your health status in a way that could affect clinical decisions.
• Attempt to reverse-engineer, decompile, or tamper with the platform.
• Share your account credentials with any third party.
• Use automated scripts or bots to interact with the platform.
• Transmit harmful, offensive, or illegal content through the app.

Limitation of Liability

To the maximum extent permitted by South African law, Flourish (Pty) Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total subscription fees you paid in the 12 months immediately preceding the claim.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot lawfully be excluded.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, notify you by email or in-app notification. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
